Immigration evaluations involve a detailed conversation with a licensed mental health professional, followed by a written report that can be used in immigration or waiver petitions. The assessment typically explores the client’s history in their home country, reasons for immigrating, and their mental and emotional well-being. Attorneys often recommend or require these evaluations as part of the immigration process to support individuals in resolving their status. Hardship Evaluations

An application for Extreme Hardships Evaluation can be submitted by a family member that legally resides in the United States. The Hardship Evaluation assessment will document the emotional, psychological, physical, educational and financial hardship that applicant would suffer if the non-citizen immigrant is deported or not allowed back to the U.S.

Spousal Abuse & VAWA (Violence Against Women Act)

The VAWA allows a non-citizen spouse or parent of U.S. citizen or Permanent Resident who has experienced abuse (Domestic Violence) to apply for legal status in the United States, have employment, authorization, and access to public benefits.  During the VAWA evaluation, is a thorough assessment documenting the physical, emotional, psychological and financial consequences of having experienced domestic abuse.

Victims of Crime (U-Visa)

A U-Visa is for victims of crimes who have been mentally or physically abused and have bee cooperating with law enforcement and government authorities in the investigation or prosecution of offenders. The U-visa is a thorough assessment evaluation the emotional, psychological, financial and physical consequence of being a victim of crime.

Victims of Human Trafficking. (T Visa)

T-Visa is a temporary immigration benefit for survivors of human trafficking that have complied with law enforcement in the investigation process of the criminal activity, allowing them to remain in the United States for four years. Qualifying family members could be considered in the T-Visa. The T-Visa evaluation, is a thorough assessment evaluating the emotional,  psychological, financial, and physical consequences of being a victim of human trafficking.

Cancellation of Removals

In Cancellation of Removal cases, an undocumented person must show that their removal from the U.S. would cause an exceptional and extremely unusual hardship to their spouse, parent, or child who is a citizen of the United States (Myers, 2020). In these proceedings, undocumented individuals request to an immigration judge that they adjust their status from deportable status to lawful admission to the United States. Psychological evaluations help inform the court about the extreme hardship separating the client would have upon a U.S. Citizen or permanent resident.
